Parallel Application for both Patent & Utility Model

The Korean Utility Model Law is unique in that it uses a combination of a non-substantive examination and a substantive examination. The applicant of a utility model application is entitled to registration without any substantive examination as opposed to a patent application. However, when the holder of a utility model registration desires to exercise his right, said holder must first obtain the examiner's decision for maintenance of the utility model registration by way of a technical evaluation, which is almost equivalent to a substantive examination in the case of a patent application.
Filing parallel applications for both patent and UM registration for the same invention is permitted; provided, however, that the claims in one application correspond to that in the other. However, the applicant must eventually select whether to proceed with the patent registration or UM registration during the course of examination.
By utilizing the parallel application strategy, one may receive the benefits of expedited protection of invention through the expedited technical evaluation procedure for UM registration. Once this protection is obtained, the applicant may seek the benefits of the longer protection of invention by deciding to proceed with the patent application for the same invention in due course.
